Welcome to NearbyPulse. These Terms of Service ("Terms") govern your use of the NearbyPulse Shopify application and related services. By installing or using NearbyPulse, you agree to these Terms.

1. About NearbyPulse

NearbyPulse is a Shopify application that helps merchants display location-aware activity messages and merchant-created announcements on their storefronts. The application also provides analytics and configuration tools to help merchants manage message display.

2. Eligibility

You must have a valid Shopify store and authority to install applications on behalf of your business.

3. Subscription and Billing

NearbyPulse is offered as a subscription through Shopify's Billing API.

• 7-day free trial
• $4.99 USD every 30 days after the trial
• Billing is managed securely through Shopify
• You may cancel your subscription at any time through your Shopify Admin

Refunds, if applicable, are subject to Shopify's billing policies and applicable laws.

4. Merchant Responsibilities

You are responsible for:

• Ensuring your use of NearbyPulse complies with applicable laws.
• Providing accurate information when configuring the application.
• Reviewing any merchant-created announcements before publishing them.
• Maintaining the security of your Shopify account.

5. Acceptable Use

You agree not to:

• Use NearbyPulse for unlawful purposes.
• Attempt to interfere with or disrupt the service.
• Reverse engineer or copy the application.
• Use the service to distribute misleading or fraudulent content.

6. Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. Maintenance, updates, network issues, or third-party service interruptions may occasionally affect availability.

7. Intellectual Property

NearbyPulse, including its software, branding, design, and documentation, is owned by NearbyPulse and protected by applicable intellectual property laws.

Installing the application grants you a limited, non-exclusive, non-transferable license to use the service while your subscription remains active.

8. Limitation of Liability

To the maximum extent permitted by law, NearbyPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application.

Our total liability shall not exceed the amount paid by you for NearbyPulse during the twelve months preceding the event giving rise to the claim.

9. Termination

You may stop using NearbyPulse at any time by uninstalling the application or cancelling your subscription through Shopify.

We may suspend or terminate access if these Terms are violated or if required by law.

10. Changes to these Terms

We may update these Terms from time to time. Updated versions will be published on this page together with the revised "Last updated" date.

11. Governing Law

These Terms shall be governed by the laws applicable to the business entity operating NearbyPulse, unless otherwise required by applicable consumer protection legislation.
